Raising Awareness of Architects’ Lien Rights (Kentucky)
What do architects need to know about payment assurance rights?
As architecture billings continue a precipitous decline and we anticipate an impending recession, it is important for architects to be equipped with knowledge about their payment assurance rights. Unfortunately, many architects do not fully understand their lien rights. This course has been developed by the AIA Small Firm Exchange (SFx) to focus specifically on lien rights for architects who practice in the state of Kentucky and aims to raise awareness of how both Kentucky statues and AIA contract documents can be leveraged to support their rights to be paid in a timely manner.

Learning objectives
- Explain that lien rights are a powerful, legal tool for collecting earned, contracted, professional fees where Architects added value to a site and construction has commenced.
- Understand what lien rights are available to architects practicing in the state of Kentucky and explore strategies for professional management of these rights, both in the immediate and the long term.
- Understand the general process and procedures for implementing lien rights on a project if necessary.
- Review the provisions of the Kentucky Fairness in Construction Act and discuss options for advocacy to expand architects’ lien rights in the Commonwealth.
